Cox warns universities not to dawdle on Proposal 2
Colleges have sought more time

Attorney General Mike Cox said Thursday he will vigorously fight lawsuits challenging the anti-affirmative action constitutional amendment voters approved Nov. 7, and he opposes granting state universities more time to comply.

Cox said requests filed earlier this week by the University of Michigan, Wayne State University and Michigan State University to win federal court approval of delays in Proposal 2's effective date appeared to be a delaying tactic designed to undermine the amendment altogether.

Unless delayed or overturned in court, Proposal 2 becomes part of the state constitution on Dec. 22.

The universities said changing the rules by which applications are considered and financial aid awarded in the middle of the academic year would create havoc and unfairness. A statement issued Thursday by U-M President Mary Sue Coleman again claimed the university is not challenging the constitutionality of the amendment, merely the timing of its implementation.

But Cox said legal documents filed by the universities indicate they view the delay as part of an overall strategy to thwart the wishes of Michigan voters.

At a news conference in Lansing, he also said he approved a request from Gov. Jennifer Granholm for representation by an independent team of state attorneys in the federal lawsuit filed by the pro-affirmative action group By Any Means Necessary (BAMN). The group says the measure would violate the equal protection clause of the U.S. Constitution.

Granholm spokeswoman Liz Boyd said the request for separate lawyers was not a declaration that Granholm will oppose implementation.

It's good to know that we have an AG who is going to go to bat for the people of Michigan...

You know, at first, I didn't feel there was any harm in allowing the universities to postpone using the new admissions standards until next year...

However, after reading WSU Law School's new admissions policy, it looks as though instead of following the change in the law that the people of Michigan adopted, the schools are really just looking for a way to get around it...and I think it's important to see how the schools will adhere to the new law NOW so any wrongdoing on their part can be corrected sooner instead of later...

The new WSU policy reads, in part:

...that the Admissions Committee is “directed to consider positively…an applicant’s demonstrated capacity to overcome or persevere against socioeconomic disadvantage...as well as the applicant's perseverance in the face of...prejudice or discrimination.”

That's all fine and dandy if the student actually has to DEMONSTRATE these factors as the wording indicates...on the other hand, if they are just going use race to make assumptions as to whether a person has had to overcome soci-economic disadvantage, prejudice, or discrimination (which it looks like they might plan to do) then we're going to have to get the courts to put a stop to such a practice, and I say it's better to do it sooner than later

lol, are you accusing ME of being a right-winger?

First off, my first post after the article was not a cut 'n paste...

second of all, I'm a moderate Democrat...not a right-winger

third, Proposal 2 is not a right-wing issue...it's a majority issue...the people of Michigan reelected Jennifer Granholm by about the same margin they passed Prop 2, so you right-wing theory does't fly

Those greedies who had unfair advantages the past forty-two years (and, quite literally, blew it, collectively) are now pissed off that those perks won't continue into perpetuity.
