The ordinance bans residents from distributing or carrying fuel, or any other flammable liquid, in portable containers between Oct. 29 through Halloween except in emergency situations. Violators will be charged with a misdemeanor, facing fines not exceeding $500 and up to 90 days in jail.

This sounds like an overproaction to me. What vehicle isn't a portable gas container? (Okay, that's a technicality.) There was a recent article that noted Angels' Night would be an early indicator of Cockrel's performance.

Is this at all related to prior restraint?

does this ordinance just add fuel to the fire, so to speak. I raises the issue so someone might try to do it just to mess with it.

There has been an Emergency Ordinance restricting the sale of Fuel on Angels Night for years this is nothing new.

Jimaz....No, "prior restraint" pertains to 1st Amendment issues; freedom of press/expression.
The only freedom being curtailed by the City's action might be mowing the lawn or running a chain saw.

I always thought that in recent years the number of fires during the days leading up to Halloween were relatively "normal". If there isn't a huge number of fires anymore, what makes this ordinance necessary?

Hudkina....I agree.

Moreover, being the sneaky SOB that I am; I would stake-out the gas stations...latch on to folks buying gas in cans on Devil's Night - follow them to their targeted structure & light their sorry asses up.

people will do what they want, doubt they'll get caught, know people won't snitch - and if so, they'll get sprung.

it seems laughable to pass such an ordinance in a city where laws against murder, arson, robbery, and rape just seem like an annoyance.

unless there's a fundamental quest for the community to protect and preserve itself, these ordinances have little bearing.

Tow truck drivers delivering fuel to cars would fall under the 'emergency' provision.

The economy is the toughest it's been in a while.

People are frustrated, this has been a traditional means of lashing out against the system.


I certainly HOPE this is a calm year...I don't want any MORE surprises this October.

The city of Detroit has passed this ordinance every year for the past 10-15 years or more. When Dennis Archer became mayor his first term, he ignored the precautions taken on previous Devils nights and it was a black eye for him. Since then, Detroit has geared up every year and will probably continue to do so even though fires that occur during the three day period from Oct 29-31 are no more than any other day of the year. Fear keeps us going...

Another law that the city can't possibly enforce. They can't even answer 911 calls in a timely manner, or respond to auto accidents. Is there any money in it? If they could search your car for a container and write you an expensive ticket, it might be enforced. Maybe. Not likely.
